  • (a) If the International Preliminary Examining Authority\n \t\t\t\t\t\t\tneeds a copy of the earlier application whose priority is claimed in the\n \t\t\t\t\t\t\tinternational application, the International Bureau shall, on request,\n \t\t\t\t\t\t\tpromptly furnish such copy. If that copy is not furnished to the\n \t\t\t\t\t\t\tInternational Preliminary Examining Authority because the applicant\n \t\t\t\t\t\t\tfailed to comply with the requirements of Rule\n \t\t\t\t\t\t\t\t17.1, and if that earlier application was not\n \t\t\t\t\t\t\tfiled with that Authority in its capacity as a national Office or the\n \t\t\t\t\t\t\tpriority document is not available to that Authority from a digital\n \t\t\t\t\t\t\tlibrary in accordance with the Administrative Instructions, the\n \t\t\t\t\t\t\tinternational preliminary examination report may be established as if\n \t\t\t\t\t\t\tthe priority had not been claimed.

  • (b) If the application whose priority is claimed in the\n \t\t\t\t\t\t\tinternational application is in a language other than the language or\n \t\t\t\t\t\t\tone of the languages of the International Preliminary Examining\n \t\t\t\t\t\t\tAuthority, that Authority may, where the validity of the priority claim\n \t\t\t\t\t\t\tis relevant for the formulation of the opinion referred to in\n \t\t\t\t\t\t\t\tArticle 33(1), invite the applicant to furnish a\n \t\t\t\t\t\t\ttranslation in the said language or one of the said languages within two\n \t\t\t\t\t\t\tmonths from the date of the invitation. If the translation is not\n \t\t\t\t\t\t\tfurnished within that time limit, the international preliminary\n \t\t\t\t\t\t\texamination report may be established as if the priority had not been\n \t\t\t\t\t\t\tclaimed.
